Contract of loans on/home renovation/purchasing cars/cars/purchasing durable goods
از آنجاییکه آقای/خانم....برابر با نامه مورخ....از این بانک درخواست وام تعمیر مسکن/خرید خودرو/خرید کالاهای بادوام....نموده و بانک با درخواست نامبرده به شروط زیر موافقت نموده است
Whereas mr./ms. ....has applied to this bank for a loan on/home renovation/purchasing cars/purchasing durable goods/in a letter dated...., and the bank has agreed to this grant on the following conditions,
این قرارداد میان بانک....منطقه....شعبه....استان به نمایندگی آقای/خانم....(که زین پس در این قرارداد بانک نامیده می شود) از یک سو و وام گیرنده آقای/خانم....شماره شناسنامه....فرزند....متولد....ت اریخ....شهرستان....ساکن....(که زین پس در این قرارداد مشتری نامیده میشود) نوشته میشود.
This contract is, therefore, drawn up between bank of....,district of....,branch of....,province of....represented by mr./ms. ....(hereinafter referred to as bank)on the one hand, and mr./ms. ....the loan applicant, holder of national id card no. ....,father's name....born on....in the city of....residing at....(hereinafter referred to as client) on the other.
ماده یک:وام تعمیر مسکن تا سقف....ریال برای انجام کلیه کارهای تعمیری و بازسازی مانند نقاشی؛نجاری؛لوله کشی؛آهنگری؛ و نصب تاسیسات و یا تعمیر آن در یک باب آپارتمان/خانه مسکونی/تجاری به پلاک ثبتی شماره....واقع در....می باشد.
Article one: the 'home revonation loan' with a ceiling of.... Rls. is payable for such activities as maintenance, restoring, painting, woodworking, piping, blacksmithing, facility installations or repairs at the house/apartment/office of the registered plate no. ....located at....
بانک هزینه های اینگونه تعمیرات را پذیرفت و در مقابل وام گیرنده متعهد شد تا هزینه اصلی و سود آن را در اقساط ماهانه طبق شرایط به بانک برگرداند.
Bank agrees to such stipulations provided that the loan applicant shall(be formally/commited/obliged/bound to)reimburse the principal sum together with the pertinent interest through monthly deposits/installments as bank deems appropriate.
ماده دو: وام خرید خودرو تا سقف....ریال برای خرید خودروهای تولید داخل و نو میباشد؛ که وام گیرنده متعهد میشود نخست پیش فاکتور خودرو را برای بانک آورده و پس از واریز دست کم بیست درصد از بهای خودرو در حسابی که به همین منظور در شعبه وام دهنده باز می نماید و فراهم کردن دست کم دو ضامن مورد تائید بانک؛ چک صادره به بهای خودرو را که در وجه شرکت سازنده صادر میشود به شرکت سازنده خودرو تحویل و پس از دریافت خودرو رسید چک ممهور به مهر شرکت سازنده را همراه با کپی سند خودرو به این بانک برگرداند.
Article two:car loans for a maximum of....Rls. are available for purchasing domestic brand new cars, wherein client covenants to provide bank with a pro-forma invoice for the car and after depositing at least twenty percent of the car price in the account opened particularly for this purpose at the loaning branch and introducing two guarantors approved by bank, submit the check issued by bank in favor of the manufacturing company and return the receipt for the check, which is sealed by the company, along with a copy of the car title to bank.
همچنین وام گیرنده متعهد شد که اصل وام و سود آنرا در اقساط ماهانه به بانک برگرداند
Client also pledges to reimburse both the principal sum and the interest thereto by monthly installments.
ماده سه: وام خرید کالاهای بادوام تا سقف....ریال تنها برای خرید کالاهای بادوام تولید داخلی قابل پرداخت می باشد.
Article three: durable goods loan for a maximum of.... Rls. is available for appliances manufactured domestically.
وام گیرنده متعهد میشود تا پس از خرید کالای مورد نظر رسید پول و فاکتور ممهور فروشگاه را به این بانک تحویل دهد.
The applicant has pledged to produce both the sealed bill of the store/shop and the receipt for the money after purchasing the goods, and to subsequently submit the same instrument to the bank.
همچنین وام گیرنده متعهد شد که اصل وام و سود آنرا در اقساط ماهانه به بانک برگرداند.
The client also covenants to return both the principal sum and the appertaining interest by monthly installments.
ماده چهار: مدت انجام این قرارداد از تاریخ درخواست حداکثر....می باشد.
Article four: deadline for the execution of this contract is within a maximum of....days.
ماده پنج:مدت بازپرداخت وام از تاریخ پرداخت حداکثر....سال می باشد.
Article five: period of reimbursement is a maximum of....years.
ماده شش: وام گیرنده ضمن عقد خارج لازم حق فسخ این قرارداد را از خود سلب نمود و متعهد شد هر گاه تصمیم به پرداخت اصل پول پیش از زمان مقرر شد سود حاصله را تا آنروز پرداخت نماید.
Article six: the client has denied himself/herself the right of cancellation of this agreement through a seperate binding contract, and pledged to disburse the interest herein to date should he/she decide to return the principal sum.
ماده هفت: وام گیرنده متعهد شد که وام را در اقساط....ماهه به میزان قسط نخست....ریال و اقساط دیگر....ریال بدون هیچ گونه عذری هر ماه پرداخت نماید.
Article seven: the client hereby solemnly pledges to return the loan through a ....-month installment plan starting with.... Rls. for the first, and.... Rls. for the remaining deposits without any excuses.
ماده هشت: چنانچه وام گیرنده در هر زمانی از پرداخت اقساط خود سر باز زند؛ همه بدهی ایشان حال شده و بانک حق دارد نسبت به بازپرداخت آن از طریق متضامنین و یا هر وسیله ممکن قانونی دیگر آنگونه که میخواهد اقدام نماید.
Article eight: should the client/refuse to fulfill his/her obligations/fail to pay any of the installments/the entire debt shall be considered immediately due, and the bznk may subject the defaulter to legal actions against the guarantors or examine other possible remedies at law as its interest may appear to recover the debts.
همچنین در زمان تسویه حساب وام؛ مبلغی برابر با....ریال برای هر روز تاخیر از سوی بانک از حساب مشتری دریافت خواهد شد.
Also, upon clearing the debt, a sum of....per each overdue day shall be charged to the client's account by the bank.
ماده نه: این قرارداد با تفاهم و توافق کامل هر دو سو بسته شده و طرفین هیچگونه اختلافی ندارند.
Article nine: this contract was drawn up after full agreement and mutual understanding of the terms stipulated herein of both parties and in the absence of any dispute.
